Channel Awesome spearheads 'Where's the Fair Use?' campaign after copyright battle

It all started with a dancing baby.

In 2007, Stephanie Lenz uploaded a video of her toddler dancing in the kitchen, Prince’s “Let’s Go Crazy” playing in the background. Eight years later, that dancing baby set a new standard for how the Digital Millennium Copyright Act (DMCA) applies on services like YouTube.

DMCA was the first amendment to copyright law since 1976, when VHS was still a brand new technology. The 1998 DMCA was an attempt to bring copyright into the digital age by protecting service providers from liability, as well as applying the laws of copyright more clearly in digital situations. Those rules have been tested by the courts repeatedly in the intervening years, most recently in September, when the United States Court of Appeals for the Ninth Circuit affirmed a lower court ruling in favor of Lenz, and held that prior to issuing a takedown under the DMCA, the copyright holder must consider fair use applications.

The court ruling may seem like a win for creators and YouTube alike, but five months later, YouTubers are facing a frontlines fair use battle all their own, one that they say allows copyright holders to exploit the system and cripple the income of people making a living on YouTube.

For Channel Awesome, an online production company that focuses on satirical media commentary, copyright complaints have become a daily occurrence. The channel frequently posts analyses and reviews of copyrighted films, and its videos often show up higher in search results than the pay-per-view options of the movies being discussed. It’s not the only online publisher following this model, with other channels like CinemaSins or WatchMojo posting the same sort of videos. These channels all have another thing in common: copyright complaints that hinge on fair use doctrine.

There’s no clear definition of how much is too much.

Fair use allows for limited use of copyrighted material without permission for specific circumstances, as dictated by a four-part test. In the case of pop culture commentary on YouTube channels, their work often falls under either parody or criticism, akin to when a journalist quotes sections of a work in order to critique or explain it. However, on a medium like YouTube, each view of that work, with the small bit of copyrighted material included, earns the uploader money for the display of that material. If too much of the copyrighted material is included in the video, YouTube diverts monetization to the original copyright holder.

However, there’s no clear definition of how much is too much, and that confusion can often result in crossed wires on how to proceed for content creators. In WatchMojo’s case, the channel was temporarily deleted in 2013 due to DMCA claims. Ironically, some of those claims were initiated by Fox, which, through another department, regularly asks WatchMojo to promote the network’s shows on its channel, according to WatchMojo founder Ashkan Karbasfrooshan.

Little has changed in the intervening three years. Just like Karbasfrooshan chose to speak out, the voices behind Channel Awesome finally became fed up with their endless cycle of Content ID claims and DMCA notices when a suspicious strike cut off all paid ads on the channel. Feeling ignored by the system and fearing their inaction would crush their company, Channel Awesome took action, launching a campaign that’s drawn attention on and off the platform.

23 days without income

On Jan. 5, Channel Awesome recieved a strike on its channel, YouTube’s way of denoting that a DMCA claim has been officially registered. This was nothing new; the channel faces these issues often. In this case, Studio Ghibli issued a DMCA notice in response to a My Neighbor Totoro review, posted as part of Channel Awesome’s Disneycember series. Under normal circumstances, channels with a single strike are limited to uploading 15-minute videos to prevent pirating full films. But as the Channel Awesome team geared up to fight the notice, as the system allows, they noticed more limits on the account. All their monetization across the channel had been turned off, as well as several other partner features. For 23 days, they couldn’t earn income on any videos from their 400,000-plus fans. On Jan. 28, they outlined the issue in a video helmed by Doug Walker of Nostalgia Critic.

“Just as we make money off of YouTube, YouTube makes money off of us,” Walker said in the video. “We were in a situation we were forced to accept, and we accepted it because the rules were in place and they seemed to follow it. But now they’re not even following their own rules.”

“We were never given a straight answer of what caused our account being perfectly fine, to having one strike and having every penalty imposed upon our account up to deletion, even when one strike is supposed to be a warning,” Channel Awesome CEO Michael Michaud explained by phone to the Daily Dot. “We had no money coming in for 23 days until that got resolved, so we had to go public because we were told it could be three to six months. Three to six months for a company where YouTube is a good chunk of our revenue—it’s going to kill something. Six months and we’re done for sure.”

Just a day later, they returned to their channel to say their entire issue was cleared up. They can’t say if it was because of the public outcry or a coincidence, and YouTube declined to comment on the record on the details of this case.

An individual battle may have been won, but the war is still raging. Channel Awesome has decided to start a broader campaign to try and implement change in the system.

What happens with a DMCA claim

DMCA claims and strikes are the highest level of escalation in YouTube’s copyright system. At the lower levels, the Content ID system is used to assess copyright claims on a video. It’s YouTube’s unique system that allows copyright holders to upload content, which is then automatically checked against all uploaded videos. Copyright holders can also do manual checks, normally in the form of companies searching for titles or terms from copyright-protected materials and issuing Content ID claims against videos accordingly.

When copyrighted material is flagged, copyright holders have several options, including blocking the video worldwide or redirecting all ad revenue to them instead of the original uploader. YouTube uses several signals to determine if DMCA complaints are coming from legitimate rights holders to help eliminate abusive complaints. Any partners found abusing these tools will have their access to the tools disabled, and repeat offenders risk having their accounts terminated. If a complaint is deemed legitimate by YouTube, the platform notifies the original uploader, who then has a chance to challenge the complaint. The copyright holder can then counter, and if the original uploader challenges it again, it escalates to the DMCA level, where the copyright holder must take legal action.

YouTube copyright issues can also bypass the Content ID stages and start directly at a DMCA level with legal notices. At the point of a DMCA complaint, YouTube is obligated to remove the offending material during the process to comply with the safe harbor provisions. Safe harbor, like the nautical term it invokes, provides a set of conditions that protect service providers like YouTube from liability in copyright claims. Once they have knowledge of a material that is potential copyright infringement, they would be in violation of safe harbor if they allowed that materials to continue on their servers.

Though not part of the DMCA requirements YouTube’s policies also institute a “three strikes and you’re out” system: At the outset of the claim, YouTube automatically issues a strike against the accused YouTube channel. If the copyright claim is eventually resolved in favor of the original uploader, that strike is removed. If you collect three strikes at one time, your account is terminated.

For creators like Channel Awesome, having DMCA guidelines in place isn’t generally a problem. But what is a problem, Michaud says, is the increase he’s seen in claims coming against creators who are using materials under fair use.

“Why are we penalized before we’re deemed guilty?”

“[Copyright claim] seems to be happening at a much more alarming pace,” said Michaud. “I think we have 11 claims pending in our account, and you can only really fight two at once. It’s a process that can take upwards of three months for you to get a video clear.”

Due to the “three strikes” rule, channels are only allowed to fight three appeals at one time. At Channel Awesome, they only fight two at once because if they fought all three and lost all three, they’d immediately lose their channel. Michaud knows Google is required to remove videos when it receives a DMCA notice, but he doesn’t understand why strikes are automatic instead of delayed until after the full decision is determined between both parties.

“Why are we penalized before we’re deemed guilty?” Michaud asked. “The strike shouldn’t hit the account until it’s been resolved in favor of the creator or of the studio. Google can still take the video down—that’s what they have to do to follow the safe harbor provisions—but they don’t have to issue the strike.”

How digital copyright works

DMCA pre-dates YouTube by a long shot. It was initially implemented in 1998 to protect websites from being held liable for copyrighted material uploaded by users. In previous iterations of copyright law, the copyright owners were dealing with older forms of media, and there was less transformational creativity.

“If the copyright owners had a problem with a TV station’s or a newspaper’s or magazine’s use of their clips, they had to sue the TV station (or send a strongly worded letter and resolve it on their own),” wrote Stacey Lantagne, assistant professor at the University of Mississippi School of Law, to the Daily Dot.“But that wasn’t such a big deal, because the scale of creativity happening was minute compared to how much the Internet exploded creativity. Plus, generally everybody was in the big media club together, so I just get the sense that there was less disagreement.”

While much of YouTube’s system exists to fulfill DMCA requirements, the fair use zone that movie reviews like Channel Awesome falls into is a much grayer area of the law.

“Traditionally, movie and television reviews have, however, been considered fair use,” wrote Lantagne. “It may be a complicated doctrine, but generally clips for the use of a review have been considered OK. We protect, under the statute, commentary and criticism, which reviews appear to be, so you’re generally OK, as long as you don’t take more than is necessary from the copyrighted work. Which is another question unto itself.”

YouTube reviews, however, often skirt the line of parody or satire, which is a much more complicated area of fair use.

“To a court, a parody is something that makes fun of another work; a satire is something that makes fun of society in general,” explained Lantagne. That means parodies borrow from the original work to be effective, while satires do not and are therefore not protected under the law. “The parody/satire distinction is a weird one that’s been criticized by lots of people, because the line quickly becomes difficult to draw. My class and I just discussed the Adult Wednesday Addams series: parody, or satire? Is she really making fun of the Addams Family, or is she just making fun of society?”

YouTube pledged in November to help fund the defense of creators in fair use legal challenges.

All the Adult Wednesday Addams episodes were removed from YouTube in April 2015 for copyright violations, and despite an update in June by creator Melissa Hunter saying she hopes for them to return, they’ve not reappeared on her channel. Overall, YouTube has one of the most robust systems to protect both creators and copyright owners alike. Other platforms like Facebook, where copyright infringement in the form of freebooting runs rampant, offer little to no protections for copyright holders, be they major motion picture studios or prolific YouTubers. Tumblr, which is fueled massively by sharing copyrighted materials, tends to delete blogs or content first and ask questions later when faced with DMCA takedowns. Twitter, plagued by stolen tweets, especially in the world of comedy, is responding to DMCA takedowns but action is so far rare.

By contrast, YouTube pledged in November to help fund the defense of creators in fair use legal challenges (in select cases). Still, for YouTube creators seeking a definitive answer on what is protected and what isn’t, there’s no clear resolution in sight.

“I think people are trying to be professional, they are trying to go the professional route, but that route isn’t working and nobody knows why,” said Michaud. “They have to come out and talk about it. This is not a once-in-a-while thing. And it’s getting worse. The idea of [the DMCA] was to protect creators or businesses, but now it’s clearly harming creators or businesses.”

What creators want

While the definitive fair use guidelines might be hard to come by, Channel Awesome has other, more concrete complaints about YouTube policy. Their chief concern is the fact that, in the time between someone making a copyright claim in the Content ID system and the time a channel might successfully dispute the claims, any money that is earned on ads for that video goes to the copyright claimant, regardless of the resolution of that dispute.

For YouTube’s part, once a dispute occurs, YouTube suspends all forms of paid ad on the content so no one makes any money until the dispute is resolved. Opponents of that policy suggest the money be put in a side account and only doled out when a counterclaim is made. There’s not legal precedent, according to Lantagne, for money to change hands before a settlement is made, at the determination of a court, not a company.

“I can't really think of situations where a court would explicitly allow money to be given to another party before a judgment had been made,” she said. “Courts do it, and it might happen in private settlement between the parties, but we don't normally allow money to be taken from someone and given to someone else without court order or previous agreement.”

Channel Awesome also takes issue with the part of ContentID that allows the copyright claimant to globally block the video. This does not actually remove the video but makes it invisible to users.

“It’s literally a strike without a strike,” said Michaud. “They’re getting the effects of a DMCA claim. If a DMCA claim happens, the video is taken down and you can't watch it anywhere. A global block is the same thing. There’s too many options they have. To be able to globally block a video without going through the legal proceedings is unfair.”

Michaud emphasized that their issues are not with YouTube, but with the system in place.

“It’s getting to a point where it’s doing so much more harm than it is good.”

“The copyright law needs to be revised, and it needs to account for the Internet,” he said. “YouTube is still young, it’s still growing, it’s still learning, and you have a bunch of people now who can have their voice be heard and making a living off entertainment.”

“I don’t think they were thinking people could make money on this. I don’t think they were thinking piracy would be as big an issue as it is,” said Walker. “It’s understandable why some of these rules would be put in place, but now it’s getting to a point where it’s doing so much more harm than it is good. … I don’t think [YouTube] is trying to be unfair on purpose; I just think they were thrown in the middle of all this and they’re trying to figure out how to fix this.”

Michaud and Walker wouldn’t elaborate on their next steps to petition for change in the YouTube system, but they did point out that several other creators have stepped up in the comments to tell their own stories and show their support.

“The focus this is to show this is not a small problem anymore,” said Walker. “This should be made a bigger priority.”

For the fair use consideration to change at a higher level, cases like Lenz vs. Universal would need to appeal to the Supreme Court. Barring that, her son, and many other babies on YouTube, will dance on. But for every one-off case won in the battle against fair use, creators like Channel Awesome will fight a slow slog until something changes with YouTube’s implementation of the DMCA.

“Last night we got noticed that two claims were released, and this morning I woke up and two new claims were in its place,” Michaud said.

Sam Pepper's YouTube channel, Twitter account go dark

Sam Pepper is no longer on the Internet.

The YouTube prankster who's come under fire in the last year and a half for sexual misconduct in both his videos and personal life, announced his departure by making most of his social media presence invisible.

On YouTube, where even after the backlash he boasts 2.3 million subscribers, his channel now reads zero videos. However, he still registers a view count of 203 million, meaning those videos were made private, not fully deleted. On Twitter he's deleted all his communication on the platform save for one tweet from February 21, reading, "I give up"

He did the same on Instagram, leaving only a black square with the same text.

The only major platform that Pepper seems to have left untouched is his Tumblr, which primarily shares photographs.

In September 2014 Pepper published a video that showed him pinching unsuspecting girls in what he called a “social experiment.” The fallout from the video included an outcry from his fellow vloggers about sexual misconduct, Pepper losing his multichannel network and ability to monetize his content as a YouTube Partner, and multiple rape accusations.

Pepper has stepped back from his video account previously, but he always returned with new videos. Most recently in November he stirred up headlines with a “murder prank” in which one friend pranked another by staging a dual kidnapping and led the prankee to believe he’d witnessed his best friend’s murder. In December Pepper launched a GoFundMe asking for donations of $1.5 million, saying he’d quit the internet for good. The page was removed from the crowdfunding site and Pepper abandoned the project.

Comedy festival recruits minority talent with wage gap pricing

Take that, wage gap.

Amid criticism that the comedy industry is a whiteboys’club, one group is making a statement. For Cinderblock Comedy Festival in New York City, female comics, LGBTQ comics, and comedians of color who submit their act before March 15 will pay only 77 cents for every dollar of the regular submission fee.

Festival director Coree Spencer told the Daily Dot she chose to tweak the submission pricing to try and send an inviting message to minority comedians who have experienced being a “token” comic.

“I want to prove that we’re token, but we shouldn’t be. We deserve our own shows, and they don’t need to be called ‘Sexy Latina Night,’ or something. We don’t need any themed ‘comedi-enne’ [shows],” Spencer said. “It is going be a diverse comedy festival, yes, but they should all be.”

During the festival’s early submission period, the $25 fee will be cranked down to $19.25. After the period ends, festival submissions will be open to all comedians with the $25 fee applied to all entries. 

Spencer acknowledged that the wage gap statistic—that women make 77 cents for every dollar a man makes—is a generalization, and that other minorities including women of color are paid significantly less. But she thought using the figure would be a way to strike a chord with diverse comics.

“The 77 cents to the dollar is definitely a political statement. Originally that 77-cent discount was supposed to be just for women in the early stages,” Spencer said. “As I was doing a little more research and kind of growing as a human being, I realized that that discount should be extended out to other groups that I want to be part of it [in order] to create the festival that I want.”

Since 2008, Spencer has done comedy in the Portland, Oregon; San Francisco; and New York City scenes. Though she enjoys the camaraderie of comedy festivals, Spencer said doesn’t take well to being the only female comic in a sea of men. She said she realized that festival bookers build their preferred lineups first, and then insert women, LGBTQ people, and people of color as an afterthought.

“If even a young person comes to our shows and they’re just like, ‘holy crap, they’re doing it. I can do it,’ that’s beautiful, that’s what we want,” Spencer said. 

“You don’t get to meet the other females, you only get to meet the guy comics,” Spencer said. “If you ask somebody, ‘Who do you know?’ it’s mostly males, because we don’t see each other unless we’re at open mics or we have a friend that knows somebody and we happen to meet them.”

For minority comics, standing out against the white, male backdrop might make comedy appear “easier” for them at the beginning of their careers. However, Spencer said standing out also allows them to be recognized before they have the time to fully develop their act—a situation she said helps fabricate the opinion that “women/gay/minority comics aren’t funny.”

This career roadblock coupled with the lack of networking opportunities gave Spencer the idea to start Cinderblock Comedy Festival. Though she wants to attract more diverse comics, Cinderblock isn’t labeled as a “female” or “diversity” festival—after all, Spencer pointed out, festivals composed entirely of male comics aren’t celebrated as “male” festivals.

“You can only rage for so long before you’re like, ‘Oh, maybe I should do something,'” Spencer said. “I want a lot of ladies there because... we need to have that community that we don’t really get. If we can all get together, have an awesome time, and laugh, we’re not hurting anybody.”

While preparing for Cinderblock, peers and other festival directors told Spencer that they noticed female comedians don’t enter into comedy festivals. Spencer was told she needed to purposely find and target comedians who aren’t straight men. Hence, her discounted rate.

While Spencer said she has received some “straight white male tears” on her Facebook page since launching the festival’s GoFundMe campaign in January, the response to her prorated entry fee has been overall positive. The festival team has grown to 21 women.

“It’s funny because some of [the team], I didn’t know them before... and that’s pretty much the whole problem,” Spencer said. “It just proves to me that there’s a need for what I’m doing. We’re working for something that’s going to be pretty exciting, and... there’s enough experience between all of us... we know the type of experience we want to have.”

In the first three days after submissions opened, the festival had already received 41 entries—27 women, two trans women, and 12 men. Though white men who don’t identify as LGBT cannot submit their performance until March, Spencer said many have reached out and commended her for creating the festival.

“It means a lot to me when [the positive comments are from] white males, because it means that they’re not mad and it means that they’re ‘normal,’” Spencer said. “A guy stopped me on the street after a show I did last night, and he was just like, ‘Hey, I just want to let you know, what you’re doing is right.’”

As the festival looms seven months away, Spencer is undecided on whether to apply the diversity pricing to ticket sales, but said the festival may opt for a presale code instead. Ultimately, Spencer said she hopes the festival’s diverse lineup will allow audiences to see comics and hear stories that they can identify with, and will inspire them to speak up themselves.

“If even a young person comes to our shows and they’re just like, ‘holy crap, they’re doing it. I can do it,’ that’s beautiful, that’s what we want,” Spencer said.

Saint West makes his official debut on Kim Kardashian's Instagram

After teasing us with a photo of her newborn son's hand earlier this year, Kim Kardashian Instagrammed the first official photo of Saint West on Monday morning. 

In a post on her app and website, Kardashian explained that she shared the picture to honor the memory of her father, the late Robert Kardashian, Sr.

"Today is my dad's birthday," Kim wrote, according to People. "I know there’s nothing more in the world he would have wanted than to meet his grandchildren. So I wanted to share this pic of Saint with you all."

Grandmother Kris Jenner also shared the pic, adding, "He's a little lovebug and an amazing gift from God. #blessed #love #precious #saintwest."

YouTube launches 2016 NextUp program to scour upcoming talent

YouTube is searching for the next generation of talent in 2016, opening applications to its successful NextUp creator camp.

While YouTubers have become successful in making their careers on video channels, there's a new class of creators who are looking for a leg up in the competitive world of brand deals, digital production, and content creation. YouTube aims to support those creators with its NextUp program, which has graduated successful channels like AVByte and Marcus Butler.

To be eligible for the program, entrants must have a channel with at least 10,000 subscribers, but no more than 100,000 subscribers. They must be monetized, have posted at least three videos in the last 90 days, and be in good standing (no active copyright strikes). Applicants must answer essay questions and submit a video that's emblematic of their channel. 

NextUp applications are open for the London, Los Angeles, and New York YouTube Spaces, with events happening in April. In addition to attending the creator camp, winners receive a $2,500 voucher toward equipment and three months of ongoing support from YouTube's Content Partnership team.

Spotify's podcast feature rolls out to iPhone users

Spotify is expanding its realm of entertainment by adding podcasts and video to its latest iOS update. Tech enthusiast Anil Dash noted the long-teased Spotify update to his Twitter page Monday afternoon. 

The new feature will give users access to news content, documentaries, and pop culture goodies through podcasts and video. For now, most of the content will roll out to free users. BBC, the Associated Press, BuzzFeed, and Fusion are a only a few of the many media outlets offering content through the streaming app’s rising facet.

Podcasts and video are available to Spotify users in the U.S., UK, Germany, and Sweden.

Willow Smith posts stunning, cryptic song 'Jimi'

Over the weekend, Willow Smith treated fans to a three-year-old find via her SoundCloud.

Rediscovering an old track she recorded at age 12, Smith posted a screenshot of her new-old track on Instagram, produced by AzZi. In the caption, she disclosed that she recorded the song, titled "Jimi," in New York City at Jimi Hendrix's Electric Lady Studios.


A chill and mature-sounding beat gives the song a relaxing vibe, and the slow and consistent rhythm of the percussion elicits a sleepy feel. Smith spends most of the song singing in a relatively low and raspy voice, adding in a few high-note flourishes near the end.

"Jimi" would have come after Smith's single "Fireball" and probably "I Am Me" as well. In a way, "Jimi" seems to fit the same kind of theme Smith sustains in her previous songs of understanding and being yourself. Although the lyrics are much more cryptic compared to Smith's obvious proclamations in "Fireball" and "I Am Me."

Right off the bat, Smith sings about being "back on Earth trying to wreak some havoc" and shares her musings throughout the verses. The song is definitely abstract, but Smith seems to have a handle on herself more so than the average 12-year-old would. She refers to herself as an "indigo," which according to Urban Dictionary, is short for "indigo child."

Now at age 15, Smith most recently released her full album Ardipithecus in December, which is thematically more upbeat than "Jimi." Perhaps "Jimi" has its own unique sound, confined to the mind of 12-year-old Willow Smith. While its a soothing, uplifting one, it's still downright mysterious. But as Smith sang, "We're all just trying to figure it out."

Dr. Luke speaks out on Kesha rape accusation with tweet storm

Though a New York judge last week ruled that pop star Kesha could not escape her recording contract with Sony producer Dr. Luke, the man who Kesha has accused of drugging and raping her a decade ago, she has experienced an outpouring of support from the likes of Taylor Swift (who donated $250,000 to Kesha's cause), Lady Gaga, and Kelly Clarkson.

For his part, Dr. Luke—whose real name is Lukasz Gottwald—has denied the charge and has accused Kesha (real name Kesha Rose Sebert) of making up the allegations of abuse in order to get out of her contract, which would allow her to record with other labels and producers.  

On Monday, Gottwald took to Twitter to fire back at the accusations.

Gottwald also tweeted, "The only truly objective person who knows the facts is the judge. The judge did not rule in Kesha's favor on Friday... I understand why people without all the information are speaking out. I can appreciate their compassion... But lives can get ruined when there’s a rush to judgment before all the facts come out. Look what happened at UVA, Duke etc... Of course any sane person is against rape and sexual assault but everybody who is commenting is doing so without knowledge or facts... They are getting behind an allegation only—motivated by money."

Gottwald also tweeted a news article stating that Kesha had previously testified under oath that he had "never made sexual advances at me."

Continued Gottwald on Twitter: "Imagine if you or somebody you loved was publicly accused of a rape you knew they didn't do. Imagine that... I have 3 sisters, a daughter, and a son with my girlfriend, and a feminist mom who raised me right... Kesha and I made a lot of songs together and it was often good but there were creative differences at times... It’s sad that she would turn a contract negotiation into something so horrendous and untrue... But I feel confident when this is over the lies will be exposed and the truth will prevail."

In a statement released earlier Monday, via Rolling Stone, Christine Lepera, Gottwald's attorney, said, "The New York County Supreme Court on Friday found that Kesha is already 'free' to record and release music without working with Dr. Luke as a producer if she doesn’t want to. Any claim that she isn’t 'free' is a myth."

You will feel sad watching James Corden's tribute to Jeb Bush

Now that Jeb Bush is out of the presidential race, the late-night hosts are paying tribute to the Bush son who couldn’t have it all.

Stephen Colbert brought out his Caesar Flickerman impression once again, but James Corden offered a more nuanced take on the former Florida governor. Bush disproved the notion that someone could lose and not win everything, Corden said, and his campaign was full of more memorable moments than someone who cooked bacon on a machine gun or claimed to have stabbed someone else. It was like he was running just for the late-night hosts.

He might not have always seemed like he wanted to be there, but he brought the meme factor when it counted. And as always, Bush had to remind us to “Please clap” at the end of his own tribute. He lost to Donald Trump; there’s no other way for him to go out.

How an inside joke birthed YouTube's Metal Kitchen

YouTube is full of by-the-book cooking tutorials, but sometimes you have to do something a little different to stand out—like convey the ingredients of shepherd's pie in a sternum-rattling growl. 

Enter Linzey Rae, singer for Denver-based metalcore quintet the Anchor. 

In late December, she released the first installment of Metal Kitchen, which features Rae screaming the recipe for shepherd's pie over an instructional video. It now has more than 1 million views—and a wonderful origin story. 

"We were in the studio and someone was going to order Chinese food for dinner," Rae explained. "While I was in the recording booth, they asked me what I wanted to eat and I screamed 'crab cheese wontons,' which created a running joke. Afterwards, our friend made a joke saying that I could write a recipe into one of our songs and people wouldn't know the difference, since the common opinion of metal music is that you can't understand what the vocalist is saying. Then the idea sort of grew from there." 

In late January, Rae released the anticipated follow-up, which included a dessert course and instructions for the perfect birthday celebration.  

"I’m more of a baker for sure," Rae said. "My stepmom and I used to bake every weekend together. She taught me everything I know about cooking. I like to cook when I have the means to, but I live in a 300-square-foot apartment with no oven, so I don’t cook much beyond what I can make on a stove top."

Rae, who has been singing with the Anchor for about a year, is presenting an interesting contrast with her YouTube channel, beyond just cooking videos. It also features the Scream It Like a Girl series, which she says was developed as a "message to the metalcore community that girls can scream just well as guys can. We’re hoping that the series will inspire more girls to actively pursue music in a male-dominated genre." 

YouTube has become a platform for experimentation and even satire for metal fans and performers. Jared Dines's parody videos explore certain genre stereotypes, and Anthony Vincent's Ten Second Songs series makes metal more accessible. But Rae is playing with ideas about gender in a genre dominated by men, one in which sexism and harassment is still very prevalent.  

Her Pop Goes Metal series reinterprets radio-friendly pop songs, and her recent "How People Think I Do Things Vs How I Really Do Them" challenges people's preconceived notions about metal fans. There's also an intimacy to the videos, which are typically filmed in kitchens or bedrooms. She says the band only started using YouTube for the Scream It Like a Girl videos, but started rethinking their approach after the shepherd's pie video went viral. They're "still learning the ins and outs" of the platform. 

In the first Metal Kitchen video, Rae casually applies makeup during the song's plodding breakdown. It's a subtle elbow to the ribs: "More metal than you" takes on a different weight. Still, Rae says she and the Anchor are just trying to uplift with music and message. 

"I am not here for people who are close-minded," she said. "If someone chooses to discredit or dismiss my message because of my gender, that is their loss. At the end of the day, music is music."

Samantha Bee shows just how un-moderate John Kasich's record really is

With Jeb Bush’s exit from the presidential race, Ohio Gov. John Kasich is being touted by some in the media as the “moderate” Republican candidate—or at least the sanest candidate still standing. But as Samantha Bee illustrated, Kasich isn't as moderate as he wants people to think—especially on LGBTQ and women’s rights.

While Kasich recognizes same-sex marriage now—and even attended the wedding of a gay friend—he was originally the governor who refused to recognize the out-of-state marriage of Jim Obergefell, whose lawsuit eventually led to the nationwide legalization of gay marriage.

But Kasich's record on women’s issues is even worse, according to Bee—and that doesn’t even include his recent remark that women “left their kitchens” to support him.

Ohio has some of the strictest abortion laws in the country, but the restrictions are added to unrelated bills to cover them up—and they don't get much attention outside of Ohio. And when Kasich is asked about them directly, he refuses to answer the question.

Kasich isn't a fan of Roe v. Wade either, which “sorta legalized it” once it became law of the land.

“Take a closer look at John Kasich,” Bee said, “because while these other chumps make empty promises to do awful stuff, the so-called moderate gets awful stuff done.”

Kesha fans want to crowdfund $2 million to pay out the rest of her Sony contract

A New York judge may have denied Kesha’s request to circumvent the terms of her recording contract last week, but the setback has only ignited her fans’ creativity for ways of showing support.

The pop singer and songwriter’s career has been in limbo since she accused longtime collaborator Lukasz Gottwald (aka Dr. Luke) with sexual assault and battery and he fired back with a countersuit. Sony, the label both of them have been working under, has remained silent on the issue, leaving Kesha’s ability to record or release any new music in limbo. 

Last week’s denied injunction ruled out one of the few solutions that might have allowed her to work without having to collaborate with her alleged abuser, and now fans are hoping to buy back Kesha’s creative freedom.

GoFundMe campaign, started by Brandon de la Cruz, is aiming to raise the $2 million remaining on Kesha’s Sony contract and hopefully liberate the singer from the fraught business relationship.

“I thought, if the courts won't help her, who can?” de la Cruz explains in the description. “We can. If we can collect enough support to show Sony we're serious, there's a chance that we could get Kesha released from her contract with them.”

De la Cruz promises 100 percent of the proceeds will be donated to Kesha directly, whether the enormous goal is met or not.  

Considering the campaign has raised over $16,000 in three days and the $250,000 Taylor Swift donated separately, Kesha may be a good chunk of her way toward buying her way out of her contract. The Daily Dot has reached out to a lawyer about the feasibility of de la Cruz’s plan and will update if we hear back.

Dying of rare cancer, comic Kickstarts enough to film final standup special

Thanks to Kickstarter and the support of the comedy community, one standup is going to live his dream of recording a one-hour special before he dies. 

Los Angeles-based comedian Quincy Jones was diagnosed with stage-four mesothelioma (a rare form of cancer) in July, and given only a year to live. When his friend and fellow comic Nicole Blaine found out one of his biggest disappointments was never getting to record a one-hour special, she jumped into action.

It turns out Blaine and her husband Mickey are also an experienced production duo, and together they teamed up to start a Kickstarter project and turn Jones' dream into a reality.

They set out with a modest $4,985 goal, taking into account things like camera, lighting, and food for the production crew, but what they didn't expect was for the project to go viral. 

His story caught the attention of the comedy community, and picked up a ton of traction on Twitter and Facebook



The duo met their goal in only two hours, and had raised more than $15,000 within the first 10 hours. The total is at over $20,000—a full $14,000 more than the production crew had been planning to work with —thanks to the help of more than 490 donations. According to a Facebook update, Blaine plans to put all the money toward making sure Jones "lives comfortably now." 

My hands have been shaking for hours and I can't stop bursting into tears. How can I thank you all? I'm moved and speechless. Today, while my 32 year old friend, Quincy Jones, was getting chemotherapy at a county hospital in Los Angeles, hundreds of people came together at the exact same time to make his dying wish come true. He was half-conscious when it was happening. In 2 hours of launching the Kickstarter campaign our little goal was met. When Quincy opened his eyes he discovered the love and support. His dream to film a stand-up comedy special just became a reality. Because of you ALL. It's amazing what can happen when people come together.

Choreographers release innovative dance routine that spills across 2 screens

It’s a YouTube dance video you have to share with a friend, or you won’t be able to watch it properly.

That’s because YouTuber choreographers Keone and Mari Madrid’s new video breaks the mold of dance on the platform by requiring more than one screen to view their piece.

“I haven’t seen a video that actually forces a user to create the experience for themselves in order to experience it correctly,” explained Keone. “It forces people to come together essentially, because you can’t experience it without another person. While that might not be the most brilliant idea in terms of getting views, it’s so awesome that it can bring people together, even if it’s for three minutes."

The married duo produced the segment with Field Day, YouTube’s program that empowers creators to try something new on the platform with the company’s help.

To make the video concept work, you need two devices. Once you've opened up each video on a separate device and positioned them next to each other, you press play at the same time and watch the dance unfold across two screens in surprising ways. Items fly between the screens, even sound swaps from one area to the next. 

“It’s essentially two videos in one thing, and it was a big challenge to make sure [each dance] relates to the other. A lot of the time, we were just guessing if it was going to work," said Keone. 

If you recognize  Keone and Mari, that’s because they're also the stars of Justin Bieber’s “Love Yourself” video.

Now the Madrids are in Amsterdam, working on a musical set to open in April that uses 3D projection along with physical sets. It’s just another way for them to offer new experiences to people through dance.

“We want people to see dancing as more than what you normally see,” Keone said. “We wanted to give people a different experience with what dance can bring them.”

Nicole Arbour's 'Dear Fat People' sequel targets 'Sports Illustrated,' Barbie, and more

Nicole Arbour is back with a follow-up to her controversial “Dear Fat People” video, this time calling out Sports Illustrated’s inclusion of a plus-size model in its swimsuit edition.

Arbour caused public outrage with her first video last September, reportedly losing a job over the video and eventually claiming it was all a marketing ploy after it racked up more than 10 million views.

“Dear Fat People 2: The Second Helping” launches into a litany of things Arbour thinks are wrong right now; she snipes at the transgender community, vegans, and feminists off the bat before honing in on body image by attacking the inclusion of model Ashley Graham in this year’s Sports Illustrated Swimsuit Edition.

Sports Illustrated swimsuit models are the mecca of physical perfection when it comes to modeling,” Arbour says in the clip. “Clearly Sports Illustrated put her in because it would cause a controversy.

“All the other models have to be in top shape, but she doesn’t,” Arbour continues. “If any of the other models showed up looking like her, they’d be fired.”

For emphasis,  Arbour repeatedly cuts between her own rant and the Louisiana authorities shaming a local gang in their own viral video. Arbour’s argument boils down to the argument that Graham is using Photoshop and cashing in on her plus-size identity.

“The truth is, if she worked out a little bit more she wouldn't be plus-sized anymore, so she couldn't sell things to plus-sized women who've made her their hero,” said Arbour. “She's not representing women, she's representing her bank account.”

Arbour also complains about Barbie's revamp to include different shapes and sizes, then closes the video by saying "all the ladies featured are gorgeous, I'm just very concerned PC is taking over."

Graham hasn't directly responded to Arbour, but did post an Instagram video of herself working out, with Beyoncé’s “Formation” playing, specifically the lyrics, “I dream it, I work hard, I grind ’til I own it/I twirl on them haters.”

Learn to build a gun rack out of hooves with 'Roadkill Art'

Perhaps it’s just best to let filmmaker Janet Arneau explain the inspiration behind her new webseries, Roadkill Art:

“It came about after seeing 18 dead deer one early morning in New Jersey on the way to church. I sat in church wondering ‘who in the world is going to pick up all those deer hit by all those cars?’ and I was just daydreaming about some sort of Beetlejuice character coming with his old truck.”

Well, it turns out that while dead animals no longer interest Michael Keaton, taxidermists are regularly in receipt of roadkill. So Arneau picked John Criminger off a list of practitioners and arrived unannounced at his property in Kershaw, South Carolina. “I pulled up in front of a small wood building greeted by a bunch of barking dogs,” recalled Arneau. “He showed me his work adorning the walls, mostly deer. If you hit a deer, you take it and have John turn it into deer steak, deer roast, or deer burgers.”

And from that meeting, Roadkill Art was born. Following Criminger, his step-daughter Bree Lee and his wife Kendra—“a nurse who works the graveyard shift and often finds fresh roadkill which she throws in the trunk and brings home”—we see the family hunt or find and process deer, fish, go frog gigging, and cook up their game. They also make things like gun racks out of hooves. Arneau reveals that future episodes will feature turkey season as well as a dead bobcat that gets dropped off for John’s attention.  

“I love John’s presence on camera,” Arneau told the Daily Dot via email, “and I love all the elements that he brings to the topic of roadkill, taxidermy and cooking game meat. He’s an excellent game meat chef. I was quite enamoured with how men, other hunters, especially teens, like to be around John. With his 17-year-old step-daughter Bree, who’s also a taxidermist and meat processor, they are a great team.”

Roadkill Art isn’t Arneau’s first webseries. In What’s Your Problem?, she asked various people the titular question and then “ha[d] a blast with their solution.” And her collection of Joe Franklin reminiscences have taken on even greater importance since the death of the stalwart talk show host early last year.

A friend insisted that Arneau meet the man who had interviewed over 100,000 people not because of his fascinating career but because he was a hoarder. This will not be a revelation to anyone who has seen the state of his office in the series. “To get to his desk once you entered the front door you had to follow a path through ceiling high walls of stuff,” recalled Arneau. “But to meet Joe was to fall in love with Joe. He was so gracious and his manners were so un-modern. He always had a fact about stars that I had never heard of. He is well missed by all of NYC!”

The battle over filling Supreme Court Justice Antonin Scalia’s seat just got even uglier—but for many Americans, it’s all part of a very familiar game.

After Republicans on the Senate Judiciary Committee vowed not to consider any Obama nominee, Trevor Noah pointed out that the act was unprecedented. But as Jordan Klepper countered on Tuesday night, it’s precisely what we’ve come to expect—especially after playing Congress: The Home Game.

A rulebook so big that nobody bothered to read it, rampant cheating, changing the rules on a whim, celebrating a victory because your opponent is losing as much as you are, and taking a month-long vacation before your turn? Yep, that’s Congress all right.

But no one really knows how the game is played—not even Congress itself, we imagine.
